    This Privacy Policy describes how Parkzy, Inc. (“Parkzy,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects personal information when you access or use the Parkzy mobile application, website, and related services (collectively, the “Platform”).

    This Privacy Policy applies to information we collect from Hosts, Drivers, prospective users, website visitors, customer support contacts, and other individuals who interact with the Platform.

    By accessing or using the Platform, you acknowledge that you have read this Privacy Policy. Where required by applicable law, we will obtain your consent separately for specific data practices, such as precise location access, marketing communications, cookies, or similar technologies.

    Capitalized terms not defined in this Privacy Policy have the meanings given in our Terms & Conditions.

    1. Information We Collect

    We may collect the following categories of personal information, depending on how you use the Platform.

    1.1 Information You Provide to Us

    You may provide us with:

    • name

    • email address

    • phone number

    • account login credentials

    • profile information

    • vehicle information, including license plate, make, model, color, and other vehicle details

    • parking listing information, including address, photos, access instructions, rules, pricing, availability, and related details

    • booking and transaction information

    • payout or tax-related information needed for Host onboarding or payment processing

    • identity verification information, if requested

    • communications with us or with other users through the Platform

    • records and content you submit in connection with disputes, refunds, chargebacks, overstays, towing, enforcement, or customer support

    We do not store full payment card numbers. Payment card information is processed by third-party payment processors.

    1.2 Information We Collect Automatically

    When you use the Platform, we may automatically collect:

    • device information, such as device type, operating system, browser type, app version, language, and settings

    • identifiers, such as IP address, device identifiers, cookie IDs, SDK IDs, and similar identifiers

    • usage data, such as pages viewed, buttons clicked, referral URLs, session data, timestamps, error logs, crash data, and other activity information

    • approximate location derived from IP address or device settings

    • precise geolocation or GPS data, if you grant permission through your device or browser

    • information collected through cookies, pixels, tags, SDKs, and similar technologies

    1.3 Information We Receive From Third Parties

    We may receive information from:

    • payment processors and payout providers

    • identity verification providers

    • analytics providers

    • customer support vendors

    • cloud hosting and infrastructure providers

    • towing or enforcement partners

    • fraud prevention or security vendors

    • public databases or government sources, where permitted by law

    • social media or third-party login providers, if you choose to connect an account

    • advertising, attribution, or marketing partners, if used

    2. Categories of Personal Information We Collect

    Depending on your interaction with the Platform, we may collect the following categories of personal information in the preceding 12 months:

    • Identifiers such as name, email address, phone number, IP address, account username, device identifiers, and license plate number

    • Customer records information such as contact details, account details, vehicle information, and certain payment-related or payout-related details

    • Commercial information such as bookings, reservations, payments, refunds, cancellations, account activity, and transaction history

    • Internet or other electronic network activity information such as browsing behavior, app activity, device logs, and analytics data

    • Geolocation data such as approximate location and, where permitted, precise location

    • Sensitive personal information, where applicable, such as account login credentials, precise geolocation, payment or financial account details processed for transactions or payouts, and identity verification data if collected

    • User-generated content such as messages, reviews, support requests, listing descriptions, uploaded photos, and dispute-related submissions

    • Professional or business information, if you interact with us on behalf of a business or commercial property

    • Inferences we may draw from the information above, such as fraud risk signals, booking preferences, service usage patterns, or account flags used for trust, safety, support, and marketplace operations

    3. Sources of Personal Information

    We collect personal information from the following categories of sources:

    • directly from you

    • automatically from your device or browser

    • from other users in connection with a booking or listing

    • from vendors and service providers

    • from payment, verification, fraud, security, and analytics partners

    • from towing or enforcement partners

    • from public or governmental sources, where permitted by law

    • from marketing, attribution, or advertising partners, if used

    4. How We Use Personal Information

    We may use personal information for the following business and commercial purposes:

    4.1 To Provide and Operate the Platform

    • create and manage user accounts

    • facilitate listings, searches, bookings, payments, payouts, refunds, and cancellations

    • provide customer service and account support

    • personalize user experience and display relevant parking options

    • enable Hosts and Drivers to complete reservations and access parking spaces

    • send service-related notices and transactional communications

    4.2 To Maintain Safety, Trust, and Platform Integrity

    • verify identities and eligibility

    • detect, prevent, investigate, and address fraud, chargebacks, account abuse, policy violations, unauthorized listings, overstays, and other prohibited conduct

    • support parking enforcement, including towing-related workflows where applicable

    • investigate incidents, disputes, complaints, safety issues, and claims

    • enforce our Terms & Conditions and other policies

    4.3 To Improve and Develop the Platform

    • analyze trends, performance, and user engagement

    • troubleshoot errors and debug the Platform

    • test features and product changes

    • improve search, mapping, reliability, fraud detection, and user experience

    • conduct internal research, analytics, and business planning

    4.4 To Communicate With You

    • send confirmations, receipts, updates, notices, and support messages

    • send security alerts and fraud notifications

    • respond to questions and requests

    • send marketing or promotional communications where permitted by law and subject to your communication preferences

    4.5 To Comply With Law and Protect Rights

    • comply with legal obligations, lawful requests, court orders, subpoenas, or regulatory requirements

    • protect the rights, safety, property, or security of Parkzy, our users, and others

    • establish, exercise, or defend legal claims

    • maintain records for legal, tax, accounting, and compliance purposes

    5. How We Disclose Personal Information

    We may disclose personal information to the following categories of recipients.

    5.1 Other Users

    To facilitate bookings and use of the Platform, we may share limited information between Hosts and Drivers, such as:

    • Driver first name, vehicle details, reservation timing, and information reasonably necessary for parking access, safety, enforcement, or support

    • Host name or business name, parking location, access instructions, and information reasonably necessary for reservation fulfillment

    We do not disclose more information than reasonably necessary for the booking, support, safety, enforcement, and Platform operations.

    5.2 Service Providers and Contractors

    We may disclose personal information to vendors, service providers, and contractors that perform services for us, such as:

    • payment processing

    • payout processing

    • hosting and cloud infrastructure

    • analytics

    • identity verification

    • customer support

    • communications delivery

    • fraud detection and security

    • towing or enforcement support

    • product performance and crash monitoring

    These parties are authorized to use personal information only as necessary to provide services to us or as otherwise permitted by law.

    5.3 Professional Advisors and Corporate Counterparties

    We may disclose personal information to auditors, insurers, attorneys, accountants, investors, lenders, acquirers, or other counterparties in connection with financing, diligence, corporate transactions, restructuring, asset sales, mergers, acquisitions, or similar events.

    5.4 Legal, Safety, and Compliance Disclosures

    We may disclose personal information when we believe in good faith that doing so is necessary to:

    • comply with applicable law, regulation, legal process, or governmental request

    • enforce our agreements and policies

    • detect, prevent, or investigate fraud, security incidents, or illegal activity

    • protect the rights, safety, property, or security of Parkzy, our users, or others

    • respond to disputes, incidents, towing matters, overstays, damage claims, or emergency situations

    5.5 Business Transfers

    If Parkzy is involved in a merger, acquisition, financing, due diligence exercise, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, personal information may be transferred as part of that transaction, subject to applicable law.

    6. Cookies, SDKs, Analytics, and Online Tracking

    We may use cookies, pixels, tags, SDKs, local storage, session replay tools, and similar technologies to:

    • operate and secure the Platform

    • remember preferences and settings

    • keep users logged in

    • understand Platform usage and performance

    • troubleshoot and debug issues

    • measure campaigns and attribution

    • improve services

    • support marketing or advertising activities, if used

    You may be able to control certain cookies or similar technologies through your browser or device settings. If you disable some technologies, portions of the Platform may not function properly.

    California Do Not Track Disclosures

    Some browsers offer a “Do Not Track” (“DNT”) setting. At this time, the Platform may not respond to all DNT signals in a uniform manner, because there is not yet a universally accepted standard for how to interpret them.

    Third parties, such as analytics, attribution, payment, security, or advertising partners, may collect information about your online activities over time and across different websites, apps, or services, subject to their own privacy policies and practices.

    7. Data Retention

    We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

    • provide and maintain the Platform

    • complete transactions and payouts

    • manage refunds, disputes, chargebacks, and claims

    • investigate incidents and enforce our Terms & Conditions

    • comply with legal, tax, accounting, and regulatory obligations

    • maintain security, backup, and fraud prevention records

    • preserve evidence and records relating to potential or actual legal claims

    Retention periods vary depending on the type of information, the nature of the relationship, legal obligations, and operational needs. When we no longer need personal information, we may delete, de-identify, aggregate, or anonymize it, unless retention is required or permitted by law.

    8. Sensitive Personal Information

    To the extent we collect sensitive personal information, we use and disclose it only as reasonably necessary:

    • to provide the services requested by you

    • to process bookings, payments, and payouts

    • to verify identity or prevent fraud

    • to maintain safety and security

    • to detect and prevent malicious, deceptive, fraudulent, or illegal activity

    • to perform services on behalf of the business

    • to maintain or improve the quality and safety of the Platform

    • for other purposes permitted by applicable law

    We do not use or disclose sensitive personal information to infer characteristics about you except as permitted by applicable law or with additional notice and any required consent.

    9. Data Security

    We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no security measure is perfect, and we cannot guarantee absolute security.

    You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly of any suspected unauthorized access to your account.

    10. Children’s Privacy

    The Platform is not intended for individuals under 18 years of age. We do not knowingly collect personal information from children under 18 in connection with the Platform. If you believe a minor has provided personal information to us, please contact us so we can review and take appropriate action.

    11. Your Choices

    You may have the following choices, depending on your location and how you use the Platform:

    • update certain profile or account information through your account settings

    • change your device settings to permit or deny location access

    • manage cookie or browser preferences

    • opt out of promotional emails by using the unsubscribe link in those emails

    • opt out of marketing texts by replying as instructed in the message

    • close your account by contacting us, subject to legal and operational retention requirements

    12. California Privacy Rights

    If you are a California resident, you may have the following rights under the California Consumer Privacy Act, as amended:

    • the right to know the categories of personal information we collect, use, disclose, sell, or share

    • the right to request access to specific pieces of personal information, subject to exceptions

    • the right to request deletion of personal information, subject to exceptions

    • the right to request correction of inaccurate personal information

    • the right to opt out of the sale or sharing of personal information, if applicable

    • the right to limit the use and disclosure of sensitive personal information, where applicable

    • the right not to receive discriminatory treatment for exercising your privacy rights

    12.1 Categories Collected, Disclosed, Sold, and Shared

    In the preceding 12 months, we may have collected and disclosed for business purposes the categories of personal information described in Sections 2 and 5 of this Privacy Policy.

    We do not sell personal information for monetary consideration.

    If Parkzy uses cookies, pixels, SDKs, or similar technologies in a manner that constitutes “sharing” for cross-context behavioral advertising under California law, California residents may have the right to opt out of that sharing. You may exercise that right by contacting us at support@useparkzy.com or by using any in-app or website cookie or privacy controls we make available.

    If Parkzy does not engage in sharing for cross-context behavioral advertising, we may instead state that Parkzy does not sell or share personal information as those terms are defined under California law.

    12.2 How to Exercise California Privacy Rights

    12.3 Verification

    We may need to verify your identity before processing certain requests. Verification may include matching information you provide against information in our records, requesting confirmation through your account, or using other reasonable verification methods.

    12.4 Authorized Agents

    If permitted by law, you may designate an authorized agent to submit certain requests on your behalf. We may require proof of the agent’s authority and may also require you to verify your identity directly with us.

    13. Rights of Users in Other Jurisdictions

    Depending on where you live, you may have rights under applicable privacy laws, including rights to access, correct, delete, restrict, object to, or receive a copy of certain personal information, or to withdraw consent where processing is based on consent.

    We will handle requests in accordance with applicable law.

    14. International Data Transfers

    Parkzy is based in the United States, and we may process and store personal information in the United States and other countries where we or our service providers operate.

    If you access the Platform from outside the United States, you understand that your information may be transferred to, stored in, and processed in jurisdictions that may have data protection laws different from those in your jurisdiction.

    Where required by applicable law, we will take appropriate steps designed to provide adequate protections for cross-border transfers.

    15. Third-Party Links and Services

    The Platform may contain links to third-party websites, services, maps, payment tools, social media features, or applications that are not operated by Parkzy. We are not responsible for the privacy, security, or content practices of third parties. We encourage you to review their privacy policies before providing information to them.

    16. Changes to This Privacy Policy

    We may update this Privacy Policy from time to time. When we do, we will post the updated version and revise the “Last Updated” date above. If required by applicable law, we will provide additional notice or obtain consent for material changes.

    Your continued use of the Platform after the effective date of an updated Privacy Policy is subject to the revised Privacy Policy, to the extent permitted by law.
