These Terms & Conditions, together with any policies, guidelines, rules, disclosures, payment terms, cancellation terms, overstay terms, towing terms, host rules, privacy terms, and supplemental terms referenced herein or made available through Parkzy, collectively form a binding legal agreement between you and Parkzy, Inc. (“Parkzy,” “we,” “us,” or “our”).
By downloading, installing, accessing, browsing, registering for, logging into, requesting parking through, accepting a parking request through, creating a listing on, booking through, paying through, messaging through, receiving payouts through, contacting support through, receiving notifications from, or otherwise using or interacting with the Parkzy website, mobile application, marketplace, payment tools, communications tools, support tools, or related services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not access, use, browse, request parking, accept parking requests, create listings, make bookings, send messages, receive payouts, or otherwise interact with Parkzy.
Parkzy is a peer-to-peer parking marketplace and technology platform.
Parkzy does not own, operate, inspect, manage, supervise, lease, control, insure, guarantee, or provide any parking space. Parkzy is not a parking operator, property owner, landlord, tenant, broker, property manager, valet, bailee, insurer, towing company, roadside assistance provider, tax advisor, legal advisor, transportation provider, employer, agent, fiduciary, or representative of any user.
Users who offer parking spaces are “Hosts.” Users who request, reserve, book, or use parking spaces are “Drivers.” A user may act as both a Host and a Driver.
When a Driver books or uses a parking space through Parkzy, the Driver and Host enter into a direct agreement with each other. Parkzy is not a party to that agreement except as expressly stated in these Terms.
You understand and agree that parking involves risk, including property damage, vehicle damage, personal injury, theft, vandalism, towing, citations, impoundment, unsafe conditions, inaccurate listings, unauthorized listings, illegal listings, user misconduct, fraud, lack of insurance coverage, and disputes between users. To the maximum extent permitted by law, you use Parkzy at your own risk.
You agree to these Terms not only by creating an account or clicking “I agree,” but also by taking any action through, on, or in connection with Parkzy, including:
Browsing the app or website.
Creating an account.
Viewing parking spaces.
Creating, editing, or managing a listing.
Requesting parking.
Accepting a parking request.
Making or receiving a booking.
Sending or receiving messages.
Uploading photos, content, or vehicle information.
Making or receiving payments.
Receiving notifications.
Contacting support.
Using any Parkzy feature.
Otherwise interacting with Parkzy.
If you use Parkzy on behalf of a company, organization, property owner, landlord, business, trust, partnership, HOA, or other entity, you represent and warrant that you have authority to bind that entity to these Terms.
You must be at least 18 years old and legally capable of entering into a binding contract to use Parkzy.
By using Parkzy, you represent and warrant that:
You are at least 18 years old.
You have the legal authority to agree to these Terms.
You will comply with all applicable laws.
You are not prohibited from using Parkzy.
The information you provide is accurate, current, and complete.
You will keep your account information accurate.
You will keep your login credentials secure.
You are responsible for all activity under your account.
Parkzy may suspend, restrict, deactivate, or terminate your access at any time if we believe you violated these Terms, created risk, engaged in fraud, harmed another user, created legal exposure, or used the platform improperly.
Parkzy provides technology that enables users to discover, request, offer, list, book, and pay for parking spaces.
Parkzy may support multiple types of parking transactions, including but not limited to:
A Driver may enter a destination, desired parking window, and price the Driver is willing to pay. Nearby users may be notified and may choose to accept the request. If a Host accepts the request and Parkzy confirms the transaction, a booking is created.
A Host may create a listing, upload photos, describe a parking space, manage availability, set pricing, and allow Drivers to book that space.
Parkzy may add, remove, modify, limit, suspend, or discontinue any feature, transaction type, pricing model, matching model, notification system, search result, ranking method, AI tool, or booking flow at any time.
Parkzy does not guarantee that any request will be accepted, any listing will receive bookings, any Driver will find parking, any Host will earn money, or any booking will be completed successfully.
Parkzy does not know and does not guarantee whether any user, listing, parking space, vehicle, property, description, photo, instruction, price, availability, charger, review, rating, identity information, or transaction is safe, legal, honest, accurate, authorized, suitable, insured, verified, reliable, or free from risk.
Parkzy does not conduct comprehensive background checks, criminal history checks, driving record checks, property inspections, legal authority checks, zoning checks, insurance checks, tax checks, lease checks, HOA checks, safety inspections, electrical inspections, or charger inspections unless expressly stated in writing.
Parkzy may offer or require identity verification through Stripe or another third-party provider. However, identity verification does not guarantee that a user is safe, trustworthy, lawful, insured, authorized, background-checked, crime-free, or risk-free.
Any profile badge, verification status, review, rating, listing review, identity check, payment check, or platform moderation is limited and does not constitute endorsement, certification, guarantee, insurance, background check, safety approval, legal approval, or suitability approval.
Users are solely responsible for deciding whether to interact with another user, offer a parking space, accept a request, or park in a space.
A booking through Parkzy grants the Driver only a limited, temporary, revocable license from the Host to park one approved vehicle in the designated parking space during the confirmed booking period, subject to these Terms, any listing rules, and applicable law.
A Parkzy booking does not create:
A lease.
A tenancy.
A property interest.
A storage agreement.
A bailment.
A valet relationship.
A landlord-tenant relationship.
A custodial relationship.
A right to exclusive possession beyond the confirmed parking period.
Any right to remain after the confirmed booking period.
Neither Parkzy nor the Host takes custody, possession, control, or responsibility for the Driver’s vehicle or personal property unless expressly agreed in a separate written agreement signed by the relevant party.
Drivers may not use Parkzy parking spaces for vehicle storage unless expressly permitted in writing by the Host and Parkzy.
If you act as a Host, you represent, warrant, and agree that:
You have the legal right and authority to offer the parking space.
Offering the space does not violate any lease, mortgage, deed restriction, HOA rule, condo rule, apartment rule, zoning rule, municipal code, permit requirement, tax rule, insurance policy, utility rule, private agreement, or other obligation.
The space is reasonably safe, accessible, and suitable for the vehicles you allow.
Your listing, photos, pricing, availability, location, access instructions, restrictions, and rules are accurate and not misleading.
You will honor confirmed bookings.
You will not list public property, government property, street parking, disabled spaces, fire lanes, loading zones, neighbor property, shared property without authorization, or any space you do not have authority to offer.
You will disclose all material limitations, including size limits, clearance limits, gate codes, permit requirements, towing risk, street-sweeping restrictions, event restrictions, construction, security concerns, animals, steep driveways, lighting issues, blocked access, charger limitations, electrical limitations, surveillance, or any condition that may affect use.
You are responsible for complying with all applicable laws.
You are responsible for obtaining any permits, approvals, licenses, consents, inspections, or permissions required to offer the space.
You are responsible for any taxes arising from your use of Parkzy.
You are responsible for obtaining any insurance you want or need.
You understand Parkzy does not provide insurance, host protection, legal protection, tax advice, safety guarantees, towing guarantees, or damage guarantees.
You are solely responsible for claims arising from your parking space, property condition, legal authority, listing accuracy, instructions, conduct, or failure to honor a booking.
If you offer EV charging, you are solely responsible for ensuring that the charger, outlet, adapter, cable, electrical system, installation, permits, utility use, pricing, resale or sharing of electricity, disclosures, insurance coverage, and legal authority are legal, permitted, code-compliant, safe, insured, and authorized in your location.
Hosts may not charge Drivers additional off-platform amounts unless expressly disclosed in the listing and permitted by Parkzy. Hosts may not require off-platform payment, cash payments, deposits, tips, separate contracts, or side agreements as a condition of honoring a Parkzy booking unless Parkzy expressly authorizes it.
If you act as a Driver, you represent, warrant, and agree that:
You will park only in the confirmed parking space.
You will park only during the confirmed booking period.
You will follow all Host instructions, posted signs, access rules, and applicable laws.
You will not block driveways, sidewalks, fire lanes, gates, garages, alleys, neighbors, trash pickup, other vehicles, emergency access, utility access, pedestrian access, or public rights-of-way.
Your vehicle is properly registered, legally operable, and insured as required by law.
You will not use the space for sleeping, camping, tailgating, parties, storage, repairs, commercial activity, illegal activity, hazardous materials, charging, washing, dumping, filming, overnight parking, or vehicle abandonment unless expressly authorized.
You will not leave valuables in the vehicle.
You are responsible for ensuring your vehicle fits the space.
You are responsible for all tickets, citations, fines, towing charges, impound fees, overstay charges, damage, cleaning costs, penalties, losses, and claims caused by your vehicle, passengers, invitees, pets, property, conduct, or failure to vacate on time.
You understand Parkzy does not guarantee safety, security, legality, availability, surveillance, or protection from theft, vandalism, towing, citation, injury, or damage.
Unless expressly permitted, oversized vehicles, trailers, RVs, boats, commercial vehicles, inoperable vehicles, leaking vehicles, and vehicles carrying hazardous materials may not be parked through Parkzy.
Drivers may be required to provide vehicle information, including make, model, color, license plate, registration information, photos, or other identifying details.
Hosts, Parkzy, towing partners, support vendors, payment processors, law enforcement, property owners, and other relevant parties may use vehicle information, photos, location information, timestamps, license plate information, and booking information to verify bookings, enforce parking rules, address overstays, support towing, prevent fraud, resolve disputes, and protect users.
You represent that any vehicle information you provide is accurate and that you have authority to park the vehicle through Parkzy.
A booking is confirmed only when accepted through the Parkzy platform and payment is successfully authorized or processed.
For on-demand requests, a Driver’s request is not a confirmed booking until a Host accepts and Parkzy confirms the transaction.
For formal listings, a booking is confirmed when the booking flow is completed and Parkzy confirms the reservation.
Parkzy may cancel, void, modify, or refuse any booking in its sole discretion if we believe there is fraud, pricing error, safety risk, legal risk, payment failure, platform misuse, user misconduct, inaccurate listing information, unavailable space, suspicious activity, or any other concern.
Parkzy is not responsible for finding replacement parking, reimbursing alternative parking, reimbursing transportation costs, covering missed events, covering travel costs, or compensating users for inconvenience, delay, stress, frustration, or lost opportunity.
Payments are processed by Stripe or other third-party payment processors. By using Parkzy’s payment features, you agree to comply with the applicable payment processor’s terms.
Drivers authorize Parkzy and its payment processors to charge their selected payment method for:
Booking amounts.
Parkzy service fees.
Payment processing fees.
Taxes where applicable.
Cancellation charges.
Overstay charges.
Host inconvenience fees.
Damage claims.
Cleaning charges.
Towing-related costs.
Impound-related costs.
Citation-related costs.
Failed payment charges.
Chargeback costs.
Administrative fees.
Any other amounts owed under these Terms.
Hosts authorize Parkzy and its payment processors to deduct Parkzy fees, payment processing fees, refunds, chargebacks, adjustments, penalties, taxes where applicable, and other amounts owed before payout.
Parkzy may change its fees, take rate, payout timing, payment methods, authorization practices, and payment policies at any time. Fee changes apply prospectively unless otherwise permitted by law.
Parkzy may delay, hold, offset, reverse, or cancel payouts if we believe there is fraud, a dispute, a chargeback, a cancellation, a safety issue, an inaccurate listing, an overpayment, a legal issue, missing tax information, missing identity information, or a violation of these Terms.
Parkzy may use Stripe for payment processing, connected account onboarding, identity verification, fraud prevention, payout processing, and tax reporting.
Some users may be asked or allowed to verify their identity through Stripe or another third-party provider. Verification may include identity document checks, selfie checks, tax information, bank account information, business information, or other information required by Parkzy or the payment processor.
Identity verification is not a guarantee that a user is trustworthy, safe, lawful, insured, authorized, background-checked, crime-free, or risk-free.
Hosts are solely responsible for determining, reporting, collecting, remitting, and paying all taxes arising from their use of Parkzy. Parkzy or Stripe may collect tax information and may generate, file, or deliver tax forms where required or supported, but Parkzy does not provide tax, legal, accounting, or financial advice.
Users should consult their own tax advisors.
Parkzy does not provide insurance, protection plans, host guarantees, driver guarantees, vehicle insurance, property insurance, liability insurance, theft protection, vandalism protection, damage protection, towing protection, personal injury protection, reimbursement coverage, or any similar coverage.
Users are solely responsible for obtaining any insurance they want or need.
Hosts should consult their homeowner’s, renter’s, landlord, umbrella, commercial, HOA, condo, apartment, or property insurance provider before offering parking.
Drivers should consult their auto insurance provider before booking parking.
Parkzy is not responsible for any insurance denial, gap, exclusion, cancellation, premium increase, lack of coverage, or claim rejection.
Unless a different cancellation policy is displayed at checkout, in the listing, or in a booking confirmation, the following default policy applies.
Before Host acceptance for on-demand requests: No confirmed booking exists. Any payment authorization may be released according to payment processor timing.
More than 24 hours before start time: Driver may receive a refund of the parking price, excluding non-refundable service fees, processing fees, promotional credits, and any amounts stated as non-refundable.
Between 2 and 24 hours before start time: Driver may receive a 50% refund of the parking price, excluding non-refundable fees.
Less than 2 hours before start time: No refund.
After booking start time: No refund, whether or not the Driver uses the space.
Parkzy may, in its sole discretion, offer a short cancellation grace period for certain bookings. Any grace period is not guaranteed and may be unavailable for on-demand bookings, event parking, high-demand areas, short-notice bookings, discounted bookings, promotional bookings, or bookings that have already started.
If a Host cancels a confirmed booking, Parkzy may refund the Driver and may penalize, suspend, delist, or deactivate the Host.
Parkzy is not responsible for finding replacement parking, reimbursing alternative parking, covering rideshare costs, covering event costs, covering travel costs, covering towing risk, or compensating users for missed events, delay, inconvenience, or consequential losses.
If a Driver arrives during the booking period and the confirmed space is unavailable, inaccessible, materially misdescribed, or unusable, the Driver must notify Parkzy promptly through the platform or at support@useparkzy.com with supporting photos or evidence.
Parkzy may, in its sole discretion, issue a full refund, partial refund, credit, or no refund depending on the circumstances.
Unless required by law or expressly stated otherwise, refunds are not provided because of traffic, weather, event cancellation, event delay, change of plans, inability to attend an event, road closure, law enforcement activity, construction, user error, failure to read instructions, vehicle size incompatibility, app outage, cellular outage, GPS inaccuracy, or late arrival.
Parkzy may issue refunds, credits, or adjustments in its sole discretion. Any courtesy refund or credit does not create an obligation to provide similar treatment in the future.
Drivers must vacate the parking space by the end of the confirmed booking period unless an extension is requested through Parkzy and confirmed.
Parkzy may allow a short grace period, such as 15 minutes, but no grace period is guaranteed. Grace periods may not apply to event parking, high-demand areas, formal listings, private driveways, spaces with another booking, or spaces where the Host has specified strict timing.
If a Driver overstays, the Driver authorizes Parkzy and its payment processors to charge the Driver’s payment method for:
Additional parking time.
Overstay penalties.
Host inconvenience fees.
Additional Parkzy fees.
Towing costs.
Impound fees.
Tickets, citations, and fines.
Damage, cleaning, or obstruction costs.
Reasonable administrative costs.
Any other losses caused by the overstay.
Unless a different overstay rate is disclosed, Parkzy may charge an overstay fee equal to the greater of:
$25 per hour, charged in 15-minute increments; or
Two times the effective hourly rate of the booking, charged in 15-minute increments.
Overstaying may result in towing at the Driver’s sole risk and expense.
A vehicle may be treated as unauthorized, abandoned, improperly parked, or subject to removal if it:
Remains after the confirmed booking period.
Blocks access.
Poses a safety risk.
Leaks fluids.
Appears inoperable.
Contains hazardous materials.
Was not the vehicle registered for the booking.
Is parked outside the confirmed space.
Violates Host instructions or applicable law.
Is associated with fraud, chargeback, nonpayment, or suspicious activity.
Drivers are solely responsible for all costs, claims, damage, towing, impoundment, storage, citations, penalties, and legal consequences arising from unauthorized, abandoned, inoperable, hazardous, or improperly parked vehicles.
Parkzy may, but is not required to, provide support to Hosts or Drivers in connection with towing issues. Parkzy may also partner with towing companies, roadside assistance providers, parking operators, property managers, security providers, or other third parties to help facilitate towing, vehicle removal, vehicle recovery, dispute support, overstay support, or related services.
By using Parkzy, you authorize Parkzy to share relevant information with towing partners, Hosts, Drivers, property owners, law enforcement, payment processors, insurers, support vendors, or other relevant parties as reasonably necessary to address towing, overstay, safety, legal, payment, or dispute issues. This information may include your name, contact information, vehicle information, license plate, booking details, location information, photos, messages, payment status, and dispute history.
Parkzy does not guarantee that towing assistance will be available, lawful, timely, successful, affordable, or appropriate. Parkzy does not control towing companies, law enforcement, municipalities, property owners, HOAs, impound facilities, or other third parties.
Hosts are solely responsible for ensuring that any towing request complies with applicable law, signage requirements, notice requirements, written authorization requirements, property rules, local towing rules, and all other legal requirements. Drivers are solely responsible for all towing, impound, citation, storage, administrative, and recovery costs arising from their overstay, improper parking, unlawful parking, or violation of these Terms.
Parkzy is not responsible for towing damage, wrongful towing, towing delay, impound charges, lost property, citation, vehicle recovery, or any act or omission of a towing provider or third party.
Parkzy’s support, communication, referral, partnership, or coordination relating to towing does not make Parkzy a towing company, property agent, property manager, bailee, vehicle custodian, law enforcement agency, or guarantor.
Drivers are responsible for damage, mess, leaks, stains, obstruction, injury, fines, towing issues, or losses caused by their vehicle, passengers, invitees, pets, property, or conduct.
Hosts are responsible for unsafe conditions, inaccurate listings, unlawful listings, lack of authority, blocked access, failure to honor bookings, and claims arising from their property or conduct.
Parkzy may, but has no obligation to, facilitate communication, request evidence, mediate disputes, charge payment methods, withhold payouts, issue refunds, issue credits, remove users, or make discretionary adjustments.
Parkzy does not decide legal liability between users and is not responsible for enforcing user-to-user claims.
Users agree to cooperate with Parkzy’s review of disputes and provide photos, timestamps, receipts, police reports, tow records, insurance information, and other evidence upon request.
Parkzy may provide messaging, calling, notification, chat, support, or other communication tools that allow users to communicate with each other or with Parkzy.
You acknowledge and agree that communications sent, received, stored, created, transmitted, or facilitated through Parkzy are not private from Parkzy.
To the maximum extent permitted by law, Parkzy may access, monitor, read, review, scan, moderate, analyze, store, copy, disclose, use, and retain communications between users, including messages, support requests, replies, photos, attachments, metadata, timestamps, location information, booking details, and related content for purposes including:
Operating the platform.
Providing customer support.
Helping resolve disputes.
Preventing fraud.
Detecting unsafe, abusive, illegal, discriminatory, or prohibited conduct.
Enforcing these Terms.
Supporting towing or overstay issues.
Processing payments, refunds, chargebacks, or adjustments.
Improving Parkzy’s products and services.
Training, developing, testing, evaluating, and improving artificial intelligence, machine learning, automation, matching, pricing, trust and safety, fraud detection, recommendation, support, and other models or systems.
Complying with law.
Protecting Parkzy, users, and third parties.
By using Parkzy’s communication tools, you consent to such access, monitoring, review, analysis, use, retention, and disclosure.
You should not share sensitive personal information, confidential information, financial information, legal information, medical information, private documents, passwords, security codes, or information you do not want Parkzy or other users to access.
If Parkzy enables phone calls, call masking, voicemail, or recorded support interactions, Parkzy may monitor, transcribe, or record such interactions where permitted by law and with any consent required by law.
Parkzy may collect, generate, analyze, infer, use, store, retain, and process information relating to your use of the platform, including:
Account information.
Profile information.
Contact information.
Vehicle information.
License plate information.
Location information.
Search activity.
Booking activity.
Pricing decisions.
Request activity.
Acceptance and rejection behavior.
Listing information.
Availability settings.
Photos and uploaded content.
Messages and communications.
Reviews and ratings.
Support interactions.
Device information.
Payment status and transaction metadata.
Fraud, risk, trust, and safety signals.
App usage, clicks, views, taps, session activity, and interaction patterns.
To the maximum extent permitted by law, Parkzy may use this information to operate, protect, personalize, improve, automate, and grow the platform, including to:
Match Drivers and Hosts.
Recommend prices.
Recommend parking spaces.
Recommend users to notify.
Detect fraud, abuse, spam, unsafe behavior, discrimination, or platform misuse.
Improve support.
Improve search, ranking, routing, notifications, availability, and pricing.
Build analytics.
Understand user behavior.
Create aggregated, anonymized, or de-identified data.
Develop new products, services, and features.
Train, fine-tune, evaluate, test, validate, improve, and deploy artificial intelligence, machine learning, automation, prediction, optimization, personalization, pricing, trust and safety, fraud detection, recommendation, and support models.
Parkzy may use human review, automated review, artificial intelligence, machine learning, and third-party service providers to process user information, communications, content, and behavior.
Parkzy may share information with vendors, contractors, service providers, payment processors, identity providers, cloud providers, analytics providers, AI providers, safety providers, towing partners, legal advisors, and other third parties as described in these Terms and Parkzy’s Privacy Policy.
Parkzy may create and use aggregated, anonymized, or de-identified data for any lawful business purpose, including analytics, research, product development, AI training, benchmarking, commercialization, and marketing. To the maximum extent permitted by law, Parkzy owns aggregated, anonymized, de-identified, derived, statistical, analytical, and model-related outputs created from use of the platform.
Nothing in this section limits any rights you may have under applicable privacy laws. Parkzy’s collection and use of personal information is also governed by its Privacy Policy.
Parkzy may use AI, machine learning, automation, algorithms, rules, heuristics, human review, or third-party systems to support:
Matching Drivers and Hosts.
Ranking listings.
Determining which users receive notifications.
Suggesting pricing.
Suggesting destinations or parking options.
Estimating availability.
Detecting fraud.
Reviewing messages.
Moderating content.
Supporting customer service.
Resolving disputes.
Assessing risk.
Personalizing the platform.
Parkzy does not guarantee that any AI, automation, ranking, notification, matching, pricing, recommendation, fraud detection, support, moderation, or safety system will be accurate, complete, fair, available, lawful in every circumstance, or error-free.
Users are solely responsible for their own decisions and may not rely on Parkzy’s AI, automation, recommendations, pricing suggestions, notifications, rankings, or support outputs as legal, financial, tax, safety, parking, towing, property, insurance, or professional advice.
Users may submit listings, photos, descriptions, messages, reviews, ratings, vehicle information, profile information, support communications, and other content.
You retain ownership of your content, but you grant Parkzy a worldwide, non-exclusive, royalty-free, sublicensable, transferable, perpetual, irrevocable license to use, host, store, reproduce, modify, adapt, translate, display, publish, distribute, create derivative works from, analyze, and otherwise exploit your content in connection with:
Operating Parkzy.
Marketing Parkzy.
Improving Parkzy.
Supporting users.
Resolving disputes.
Enforcing these Terms.
Preventing fraud.
Supporting towing and overstay issues.
Training, testing, developing, and improving AI, machine learning, automation, trust and safety, recommendation, pricing, matching, and support systems.
Creating aggregated, anonymized, de-identified, statistical, analytical, or derived data.
You represent that your content is accurate, lawful, non-infringing, and not misleading.
Parkzy may remove, edit, restrict, moderate, or refuse content at any time.
Reviews and ratings must be honest and based on real experiences. Users may not post fraudulent, retaliatory, abusive, discriminatory, threatening, irrelevant, misleading, or unlawful reviews.
Parkzy may remove, edit, suppress, or restrict reviews or ratings in its sole discretion.
Parkzy does not guarantee the accuracy of reviews or ratings and is not responsible for user opinions or statements.
Users may not use Parkzy to identify, contact, solicit, or transact with another user outside Parkzy to avoid fees, rules, protections, payment processing, or platform requirements.
If you complete or attempt an off-platform transaction, Parkzy may suspend or terminate your account, cancel bookings, withhold payouts, charge fees, and pursue available remedies.
Parkzy is not responsible for any harm, loss, nonpayment, property damage, personal injury, fraud, towing, citation, or dispute arising from off-platform transactions.
You agree not to:
Misrepresent your identity, vehicle, property, authority, listing, location, pricing, availability, or intentions.
Use Parkzy for illegal, fraudulent, abusive, threatening, discriminatory, harassing, unsafe, or deceptive activity.
Circumvent Parkzy fees or move transactions off-platform.
Contact users for unrelated purposes.
Enter private property beyond what is reasonably necessary to use the booked parking space.
Damage, photograph, film, harass, stalk, threaten, or disturb users, neighbors, property owners, or third parties.
Use the platform to transport, store, hide, or facilitate weapons, hazardous materials, stolen property, controlled substances, contraband, or unlawful activity.
Interfere with Parkzy’s operation, security, payment systems, or user experience.
Create fake accounts, fake listings, fake bookings, fake reviews, or fraudulent chargebacks.
Scrape, crawl, copy, reverse engineer, train competing models on, or misuse Parkzy’s data, technology, or content.
Use Parkzy to violate any lease, HOA rule, property rule, law, regulation, or third-party right.
Abuse support, towing support, refunds, chargebacks, promotions, referrals, or user communications.
Discriminate against users based on protected characteristics.
Threaten, intimidate, or retaliate against any user, Parkzy employee, contractor, vendor, towing provider, or support agent.
Parkzy may investigate and take action in its discretion, including canceling bookings, removing listings, withholding payouts, charging fees, reporting conduct to law enforcement, suspending accounts, or terminating accounts.
Hosts may not list or offer:
Public street parking.
Government-owned spaces without authorization.
Neighbor property without authorization.
Shared property without authorization.
Disabled parking spaces unless legally authorized for the specific Driver.
Fire lanes.
Loading zones.
Emergency access areas.
Sidewalks.
Bike lanes.
Bus lanes.
Spaces subject to exclusive third-party rights.
Spaces that violate leases, HOA rules, municipal codes, zoning rules, or other obligations.
Spaces where parking creates a safety hazard.
Spaces where towing, citation, or enforcement risk is not properly disclosed.
Parkzy may remove prohibited spaces at any time but has no obligation to identify all prohibited spaces.
Parkzy may allow Hosts to indicate that electric vehicle charging is available at or near a parking space.
Parkzy does not own, operate, install, inspect, maintain, test, monitor, control, certify, or guarantee any electric vehicle charger, outlet, adapter, cable, electrical panel, wiring, circuit, utility connection, charging equipment, or related infrastructure.
Unless a listing expressly permits electric vehicle charging, Drivers may not charge vehicles at a Host’s property.
If EV charging is offered, the Host is solely responsible for determining whether offering, advertising, providing, reselling, sharing, or charging for EV charging is legal and permitted at that location. This includes responsibility for complying with all applicable federal, state, local, municipal, zoning, building, electrical, fire, safety, utility, HOA, condo, apartment, lease, insurance, tax, and private-property rules.
Parkzy does not verify or guarantee that any EV charger, outlet, adapter, cable, electrical system, installation, utility use, pricing, electricity resale, or charging arrangement is legal, permitted, properly installed, properly inspected, code-compliant, utility-compliant, safe, functional, available, compatible, insured, or suitable for any Driver’s vehicle.
Hosts represent and warrant that, before listing or offering EV charging through Parkzy, they have all required rights, permissions, permits, inspections, approvals, licenses, utility authorizations, insurance permissions, property permissions, and legal authority necessary to do so.
Drivers are solely responsible for confirming that any charger is compatible with their vehicle and for following all Host instructions, manufacturer instructions, safety rules, posted rules, time limits, charging limits, and applicable laws.
Parkzy is not responsible for charging speed, charger availability, charger failure, electrical failure, utility charges, utility disputes, fire, overheating, electrical damage, vehicle damage, personal injury, property damage, inaccurate charger descriptions, lack of compatibility, interrupted charging, insufficient charge, or disputes relating to EV charging.
Hosts and Drivers agree to release, defend, indemnify, and hold harmless Parkzy from any claims, losses, damages, fines, penalties, citations, utility charges, injuries, property damage, vehicle damage, electrical issues, fire, permit issues, insurance issues, tax issues, utility issues, or legal violations arising out of or relating to EV charging.
Hosts may have cameras, security systems, license plate readers, gate systems, lighting, or other property-security features where lawful. Hosts are solely responsible for complying with all laws relating to surveillance, recordings, notices, privacy, audio recording, video recording, and data retention.
Hosts must not place hidden cameras or recording devices in areas where a person has a reasonable expectation of privacy.
Parkzy does not provide security, surveillance, monitoring, emergency response, guard services, or crime prevention. Any security feature disclosed by a Host is not guaranteed by Parkzy.
Drivers are responsible for entering only the areas reasonably necessary to access and use the confirmed parking space.
Parkzy is not an emergency service. If you believe there is an emergency, threat, crime, fire, injury, dangerous condition, vehicle break-in, confrontation, or immediate safety risk, call 911 or local emergency services first.
Parkzy may provide support but does not guarantee response times, emergency assistance, law enforcement assistance, towing availability, or resolution of safety issues.
Users are solely responsible for understanding and complying with all laws, ordinances, rules, regulations, leases, HOA rules, condo rules, apartment rules, zoning codes, tax laws, insurance requirements, signage rules, parking rules, fire codes, building codes, electrical codes, disability access rules, towing rules, consumer protection laws, privacy laws, utility rules, and private agreements that apply to their use of Parkzy.
Parkzy does not guarantee that using, offering, listing, booking, charging for, or parking in any space is legal in any location.
Parkzy may remove listings, cancel bookings, restrict features, or cooperate with authorities if we believe a listing or booking may violate applicable law.
Parkzy may offer promotional codes, referral credits, discounts, rewards, or other incentives. Parkzy may modify, limit, revoke, suspend, or terminate promotions at any time.
Promotions have no cash value unless expressly stated. Promotions may not be sold, transferred, combined, duplicated, or used for fraudulent activity.
Parkzy may reverse credits, cancel bookings, suspend accounts, or charge payment methods if we believe a promotion was abused, misused, obtained fraudulently, or used in violation of these Terms.
If a payment fails, is reversed, is charged back, or is otherwise not received, you remain responsible for all amounts owed.
Parkzy may retry payment methods, offset payouts, suspend accounts, cancel bookings, restrict access, refer debts to collection, or pursue legal remedies.
You agree to reimburse Parkzy for chargeback fees, failed payment fees, collection costs, attorneys’ fees, and other costs arising from unpaid amounts where permitted by law.
You knowingly and voluntarily assume all risks arising from your use of Parkzy, including risks associated with:
Parking on private property.
Entering or approaching unfamiliar property.
Interacting with strangers.
Theft, vandalism, collision, fire, flood, weather, natural disasters, or vehicle damage.
Unsafe property conditions.
Inaccurate listings or instructions.
Unauthorized listings.
Illegal listings.
Towing, citations, fines, and impoundment.
Lack of insurance coverage.
User misconduct.
Criminal activity.
Payment disputes.
Tax obligations.
Failure of a Host or Driver to perform.
Platform errors, bugs, outages, or inaccurate information.
AI, matching, pricing, notification, or recommendation errors.
EV charging issues.
Electrical issues.
Towing support or towing provider issues.
You agree that Parkzy is not responsible for these risks to the maximum extent permitted by law.
Parkzy’s collection, use, disclosure, retention, and processing of personal information is governed by Parkzy’s Privacy Policy.
Because Parkzy uses third-party providers such as Stripe, cloud providers, analytics providers, AI providers, communication providers, identity providers, and towing partners, your information may also be processed by those providers under their own terms and privacy policies.
By using Parkzy, you consent to Parkzy’s collection, use, sharing, and processing of information as described in these Terms and Parkzy’s Privacy Policy.
You agree that Parkzy may contact you by email, phone, SMS, push notification, in-app message, or other electronic means regarding your account, bookings, payments, safety issues, disputes, towing issues, overstay issues, support requests, marketing, or platform updates.
You are responsible for keeping your contact information current.
You may opt out of promotional communications where required by law, but transactional, safety, legal, support, payment, and account-related messages may still be sent.
Parkzy may integrate with or rely on third-party services, including Stripe, maps, identity verification providers, AI providers, communication tools, analytics providers, hosting providers, towing providers, support vendors, legal vendors, and other service providers.
Parkzy is not responsible for third-party services, acts, omissions, outages, errors, fees, terms, privacy practices, data practices, or failures.
Your use of third-party services may be governed by separate third-party terms.
If you access Parkzy through an app downloaded from the Apple App Store or Google Play, you agree to comply with the applicable app store terms.
Apple and Google are not responsible for Parkzy, bookings, users, listings, parking spaces, payments, disputes, towing, claims, or support.
Parkzy owns all rights, title, and interest in and to the Parkzy platform, software, technology, trademarks, logos, designs, content, data, compilation, user interface, analytics, algorithms, models, systems, and related intellectual property, except for user content licensed to Parkzy.
You may not copy, reproduce, modify, distribute, sell, lease, reverse engineer, scrape, frame, mirror, train competing models on, or exploit Parkzy’s platform, content, data, or technology without written permission.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKZY PROVIDES THE PLATFORM “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
PARKZY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AVAILABILITY, ACCURACY, RELIABILITY, SAFETY, LEGALITY, SECURITY, AND ERROR-FREE OPERATION.
PARKZY DOES NOT WARRANT THAT:
THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
ANY PARKING SPACE WILL BE AVAILABLE, SAFE, LEGAL, OR SUITABLE.
ANY USER IS HONEST, SAFE, VERIFIED, INSURED, OR AUTHORIZED.
ANY LISTING IS ACCURATE.
ANY VEHICLE WILL BE SAFE FROM DAMAGE, THEFT, VANDALISM, TOWING, OR CITATION.
ANY HOST OR DRIVER WILL PERFORM AS EXPECTED.
ANY DISPUTE WILL BE RESOLVED IN YOUR FAVOR.
ANY AI, MATCHING, PRICING, SEARCH, RANKING, FRAUD DETECTION, RECOMMENDATION, OR NOTIFICATION SYSTEM WILL BE ACCURATE, COMPLETE, OR ERROR-FREE.
ANY TOWING SUPPORT OR PARTNERSHIP WILL BE AVAILABLE, SUCCESSFUL, OR FREE FROM ERROR.
ANY EV CHARGER, OUTLET, ELECTRICAL SYSTEM, OR CHARGING ARRANGEMENT WILL BE SAFE, LEGAL, AVAILABLE, COMPATIBLE, CODE-COMPLIANT, OR FUNCTIONAL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKZY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, INVESTORS, PARTNERS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST OPPORTUNITY, LOST GOODWILL, LOSS OF DATA, SUBSTITUTE PARKING COSTS, MISSED EVENTS, TRAVEL COSTS, RIDESHARE COSTS, VEHICLE DAMAGE, PROPERTY DAMAGE, PERSONAL INJURY, EMOTIONAL DISTRESS, TOWING, CITATIONS, IMPOUND FEES, INSURANCE DENIALS, USER MISCONDUCT, AI ERRORS, DATA ANALYSIS ERRORS, MATCHING ERRORS, RECOMMENDATION ERRORS, EV CHARGING ISSUES, ELECTRICAL ISSUES, OR THIRD-PARTY SERVICE FAILURES, EVEN IF PARKZY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKZY’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF:
THE AMOUNT OF PARKZY FEES YOU PAID TO PARKZY IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, Parkzy’s liability will be limited to the maximum extent permitted by law.
To the maximum extent permitted by law, you release Parkzy and its officers, directors, employees, contractors, agents, affiliates, investors, partners, suppliers, and licensors from all claims, demands, damages, losses, liabilities, costs, and expenses arising out of or related to:
Your use of Parkzy.
Any booking, listing, parking space, Host, Driver, vehicle, property, or transaction.
Any user conduct or misconduct.
Any damage, theft, vandalism, injury, towing, citation, overstay, unsafe condition, inaccurate listing, unavailable space, unauthorized listing, or illegal parking.
Any dispute between users.
Any off-platform transaction.
Any lack of insurance coverage.
Any use of communications, behavioral data, user content, AI, machine learning, analytics, matching, pricing, ranking, recommendations, or automation.
Any towing support, towing partnership, or third-party towing provider.
Any EV charging, charger, electrical system, utility issue, fire, electrical damage, vehicle damage, or charging-related dispute.
If you are a California resident, you waive California Civil Code Section 1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
You agree to defend, indemnify, and hold harmless Parkzy and its officers, directors, employees, contractors, agents, affiliates, investors, partners, suppliers, and licensors from and against any claims, demands, damages, losses, liabilities, fines, penalties, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
Your use or misuse of Parkzy.
Your violation of these Terms.
Your violation of any law or third-party right.
Your listing, parking space, vehicle, property, conduct, or content.
Your failure to have legal authority to offer a parking space.
Your failure to comply with lease, HOA, condo, apartment, municipal, zoning, tax, towing, signage, electrical, utility, permitting, or insurance obligations.
Your damage to property or injury to any person.
Your overstay or failure to vacate.
Your towing, citation, impoundment, or parking violation.
Your taxes or tax reporting obligations.
Your dispute with another user.
Your off-platform transaction.
Your communications with another user.
Your request for, use of, or reliance on towing support.
Your violation of privacy, publicity, intellectual property, or other rights.
Your offering, advertising, providing, using, reselling, sharing, or charging for EV charging.
Any fire, electrical issue, vehicle damage, property damage, permit issue, insurance issue, or utility issue relating to your EV charger, outlet, electrical system, or charging arrangement.
Parkzy may assume exclusive control of any defense at your expense. You may not settle any claim involving Parkzy without Parkzy’s written consent.
Parkzy may suspend, restrict, deactivate, or terminate your account or access to the platform at any time if we believe you have violated these Terms, created risk, harmed another user, engaged in fraud, misused the platform, received excessive complaints, created legal exposure, or acted inconsistently with Parkzy’s interests.
Upon termination, you remain responsible for all amounts owed, disputes, claims, indemnity obligations, taxes, chargebacks, overstay fees, towing costs, EV charging issues, and other obligations arising before or after termination.
Parkzy may update these Terms at any time. If changes are material, Parkzy may provide notice through the platform, email, or other reasonable means.
Updated Terms are effective when posted unless otherwise stated.
Your continued use of Parkzy after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using Parkzy.
These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement below.
Mandatory consumer protection laws of your state of residence may also apply where required by law.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Before filing a claim, you agree to first contact Parkzy at support@useparkzy.com and provide your name, account email, description of the dispute, requested relief, and supporting information.
You and Parkzy agree to attempt in good faith to resolve the dispute informally for at least 30 days.
Except for the exceptions below, you and Parkzy agree that any dispute, claim, or controversy arising out of or relating to these Terms, Parkzy, the platform, a booking, a listing, payments, users, parking spaces, communications, data use, AI use, towing, EV charging, or any related transaction will be resolved by binding individual arbitration, not in court.
The arbitration will be administered by the American Arbitration Association or another mutually agreed arbitration provider under its applicable rules.
Either party may bring the following claims in court:
Individual claims in small claims court.
Claims for intellectual property infringement.
Claims seeking emergency injunctive relief.
Claims that cannot legally be compelled to arbitration.
Requests for public injunctive relief where required by California law.
YOU AND PARKZY AGREE THAT EACH MAY BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF, CLASS MEMBER, REPRESENTATIVE, OR PARTICIPANT IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION.
YOU AND PARKZY WAIVE ANY RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Unless otherwise required by law, arbitration hearings will be conducted remotely or in Los Angeles County, California.
You may opt out of this arbitration agreement by sending written notice to support@useparkzy.com within 30 days after first accepting these Terms.
Your notice must include your full name, account email, mailing address, and a clear statement that you opt out of arbitration.
Opting out does not affect any other part of these Terms.
These Terms constitute the entire agreement between you and Parkzy regarding your use of the platform.
If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
Parkzy’s failure to enforce a provision is not a waiver.
You may not assign these Terms without Parkzy’s consent. Parkzy may assign these Terms without restriction.
No agency, partnership, joint venture, employment, franchise, fiduciary, broker, landlord-tenant, insurer, towing-company, roadside-assistance, property-manager, or other special relationship is created by these Terms.
Sections intended to survive termination will survive, including payment obligations, content licenses, data rights, AI rights, communication review rights, releases, disclaimers, limitation of liability, indemnification, arbitration, and dispute resolution provisions.
